Brian J. Markowitz
Mr. Markowitz is a Senior Counsel with Klein & Solomon, LLP, and focuses his practice on complex commercial litigation, construction disputes, real estate litigation and construction contract drafting and negotiation. Mr. Markowitz represents property owners, developers, construction managers, general contractors and design professionals in all phases of litigation, from case inception through trial or alternative dispute resolution, and, when necessary, at the appellate level. He is admitted to practice law in the States of New York and New Jersey and the United States District Court, District of New Jersey as well as the Southern and Eastern Districts of New York.
Mr. Markowitz’s experience includes litigating mechanics' lien foreclosures, delay claims, extra work disputes, defaults and wrongful termination claims, trust fund claims, surety and insurance issues, design defect claims, adverse possession claims, license agreements, and coop/condo disputes. He has extensive experience in all aspects of contract drafting, negotiation and review, including the drafting, negotiation and review of construction management and general construction agreements, architectural and engineering agreements, construction access and license agreements, consulting agreements and subcontracts.  
Mr. Markowitz has been selected by Super Lawyers Magazine as a Rising Star in Construction in New York City, an honor given to less than 2.5% of attorneys in the state. Notably, he is the drafter of New York Lien Law Section 44-b, dealing with necessary parties to a public improvement mechanic's lien foreclosure action.  
Prior to joining Klein & Solomon, LLP, Mr. Markowitz was associated with Duane Morris, LLP and prior to that he was associated with Thelen, LLP. He currently serves on the International Council of Phi Delta Phi International Legal Honor Society. Additionally, he has volunteered to assist victims of the September 11 attacks in applying to the Victims Compensation Fund and has worked with victims of human trafficking to expunge their criminal records resulting from having been trafficked. Mr. Markowitz is also active within the New Jersey Chapter of the Leukemia and Lymphoma Society.
Mr. Markowitz received his Juris Doctor from Brooklyn Law School and graduated from the State University of New York at Oneonta, where he earned a Bachelor of Arts.
